A / Generalities: 

A1 /The present general sales conditions are contractual relations between the business Cosmoledo and the client defined below; as the user of a Cosmoledo sight accepting the present general sales conditions.

A2 /The general sales conditions are notably the conditions of ordering, payment, delivery and management of eventual returns of products ordered by the clients.

A3 /The client can simply consult, freely and at anytime, the general sales conditions by clicking on the link ÒconditionsÓ. Therefore all product orders made by the client implies the definite and irrevocable agreement of the client on the entirety or the general sales conditions.

B /Method of Ordering:

B1 /If the client would like to place an order, they shall fill out the questionnaire according to the instructions given. The client shall give the necessary information about their identification and notably their: first name, last name, postal address, telephone number and email address. .

B2 /Once the client has chosen their product(s), and validates their order definitely, by clicking yes on the disclaimer on the screen, they manifest their engagement and their acceptance of the general sales conditions. 

B3 / All orders passed by Cosmoledo shall be confirmed to the client by an order confirmation, as soon as possible, either by email, telephone or postal mail. 

B4 / No order cancellation shall be accepted without the accord and consent from Cosmoledo.

B5 / The product photos and descriptions are given only to indicate the name of each item, notably the theoretic weight of gold as well as the dimensions or indication of carats, the prices are indicative and can evolve; at all times any technical error and/or typographical error give no right to client reclamations towards Cosmoledo. Client reclamation cannot be engaged to Cosmoledo.

B6 / Cosmoledo advises its client to order directly on an online websight supplier, and to print a copy of their order and keep it, until they receive a confirmation email of the order addressed by Cosmoledo.

C / Method of Payment: 

C1 / All purchases on a Cosmoledo site are payable to the invoice only. No product can be shipped to a client if it has not been paid in full, all taxes included and the eventual shipping and handling. 

C2 / So that no client contests the amount they have paid, Cosmoledo addresses the client an order confirmation directly from the order registration.

C3 / Cosmoledo reserves the right to: suspend all order management and all delivery in case of credit card payment refusal, or other payments from the part of official accredited organisms, or in case of non payment or fraud, and to judiciously prosecute said non payment or fraud.

C4 / All payments delayed due to an initial rejected payment by credit card, or by other means of payment, with the application of late fee penalties equal to the total price plus 4 percent interest, applicable to count from the delivery day of the products and application of a penal clause.

C7 / In the case of a credit card payment, a client could be asked to justify their identity to certify payment. The client can remove this obligation by paying by check. 

D / Product Info: 

D1 / Cosmoledo sites, presenting the products being sold with the necessary characteristics, allow to respect the article L 111-1 of the Consumption Code {of France}. .

D2 / The documents that are associated to the products on the Cosmoledo sites {descriptions, technical files, photos, drawings, plans, graphs, etc.}are given to indicate, and not engage Cosmoledo to respect the reality of the products, and cannot put into question the validity of an order or a sale. Cosmoledo can in no case be held responsible to reimburse or cancel an order following user impossibility of the product purchased for a reason of incompatibility with the product composition.

D3 /The products and the prices presented on the Cosmoledo sites are only available in the limited available stocks, and give no reimbursement in case of rupture or cancellation.

E / Price: 

E1 / The sale price of our products are listed in Euros, all tax included {VAT 19.6 percent} 

E2 / The price of our products can evolve at any time. The sale price held for the purchase of a product corresponds to that observed on line at the moment of registering the order on the website {except typographical errors}.

E3 /The eventual delivery fees and insurances are paid for by the client, and are billed in addition to the sale of the products. 

E4 / The client shall always be informed before the definitive order registration the cost of delivery; said order and the payment shall be ask to the client for the total buying price, integrating the price of deliver and of the products ordered. The confirmation of the payment accord of the order by the client implies that the client accepts to pay the delivery fees. The delivery fee can not constitute a valuable reason for order cancellation after the definitive registration of the order. 

F / Delivering process: 

F1 / The purchased products on a Cosmoldo website an be delivered to Metropolitan France and all other country proposed by the site.

F2 /Delivery is made to the address specified by the client on their account. Delivery shall be made by La Poste or by a transporter. The client cannot intervene once the order is validated by the client and the payment effected in its integrity. The payment centers concerned have given their payment accord. In case od refused payment, the order shall be automatically canceled.

F3 / In case of client absence during delivery, a package slip shall be deposited in the mail box. The client can then accept their package at the post office or the transporters office. 

F4 / The delivery shall be considered finished once presented to the delivery address indicated by the clients order. The delivery shall be in effect once the client has signed the delivery order. 

F5 / The client has the obligation to verify the conformity of the delivered merchandise, before signing the delivery order. 

F6 / All delivery anomalies {bent or damaged product, broken box or product, etc.} should be imperatively marked on the delivery order form under the reserve manuscript, accompanied by the signature of the client. The client should equally confirm these anomalies by addressing the transporter in the following 2 days after the delivery date, along with a letter explaining the damages. 

F7 / Le client devra transmettre une copie de ce courrier par fax ou par simple lettre à la société Cosmoledo.

F8 / Les coordonnées du transporteur figureront sur le bon de livraison.

G / Delivery Delay

G1 / If the ordered artile is in stock, the delivery delay should be about 8 to 10 days. In case of the product is out of stock, the delay could be 2 to 3 weeks. 

G2 / The delivery delay takes effect from the moment of payment or confirmation of payment. 

G3 / In case of major forces or exceptional events { i.e. natural disaster, epidemic, strike, lock out, etc.} delaying or making delivery impossible, Cosmoledo is removed from all responsibility. 

G4 / In all cases, delivery can be delayed only if the client is up to date with its obligations to Cosmoledo.

G5 / In case a product is unavailable, or if Cosmoledo can not deliver the purchased product[s], the client shall be proposed a replacement product at equal price, or the possibility of product reimbursement.

H / Claims: 

H1 / The client should contact Cosmoledo the same day of delivery, or at the latest the next business day after delivery for all claims of a delivery error or of product non conformity or quality, based on the item number on your purchase order. All claims filed 2 days after delivery are rejected. 

H2 / Please send your claim via certified mail to Cosmoledo

H3 / All claims non effected in the defined rules listed above, and in the given delays, can not be taken in account of by Cosmoledo, and removes Cosmoledo from all liability or responsibility. 

I / Satisfaction Guaranteed or Your Money Back: 

I1 / Including the day of delivery of your order, you have seven days to return you product. At all times must your returned item be repackaged in the same box and packaging material it was sent in. The item needs to be in perfect condition in order to be accepted as a return. The initial delivery fee, and the cost of the returned delivery package remain at the cost of the client.

I2 / In order for your order to be treated, you need to contact CosmoledoÕs After Sales Service to inform us of your intention to return your article, and to obtain an order number as well as our return policy.

I3 / The returned articles need to be insured for the full price of your purchased order. In the case an uninsured returned package is lost or stolen during transit, Cosmoledo is not responsible for said items as they were not insured.

I4 / Items neither acceptable to return or exchange: special order or sizing, as well as all the piercing articles.

J / Guarantee: 

J1 / All articles sold on line by Cosmoledo are guaranteed 1 year against all hidden vies unless indicated otherwise. 

K / Réserve de propriété et responsabilité : 

K1 / Cosmoledo reserves the merchandise property until the integral payment of the client is made. The property transfer of products is made after the integral payment moment. During the delivery period until the transfer of property the risks of loss, theft or destruction are at the clients cost. 

K2 / If the clients payment obligations are not executed, for whatever reason, Cosmoledo reserves the right to immediately restitute delivered items at the cost, risk and peril of the client. {All eventual repairs are at the clients cost}.

L / Billing: 

L1 / A detailed bill shall be sent to you with your delivered package. The total VAT indicated leaves the possibility to businesses, liberal professions and collective agencies to recouperate the paid tax in the conditions of the General Code of Taxes.

M / Jurisdiction Attributes:

M1 / The General Sales Conditions listed above are under French Law. All contestations concerning these conditions of sale shall be submitted to the Business Court of Thonon les Bains {France, 74200}
